Cabarete Mayor accused of stealing funds

Cabarete Mayor, Gabriel Antonio Mora (Canoa), has been accused of misappropriating Cabarete Town Hall funds by the Association for the Development of Cabarete (ADECA).

Victor Mena Graveley, who is also president of the Bar Association of Puerto Plata, speaking on behalf of ADECA, says they have evidence that Mora has misappropriated more than 200 million pesos (approx US$ 5.2 million) from the Town Hall, and has asked the local court to remove him from office.

On January 12, 2012, ADECA say they requested Cabarete Town Hall to reléase accounting information including revenue and expenditure, and details of contracts signed by the council from 2004.

Mora refused the request, claiming that since he took over as director of the Municipality on August 16, 2010, the law does not oblige him to issue, grant or provide information regarding the previous years when the Municipality was not under his control.

Another accusation made by lawyer Aristides Trejo, on behalf of businessman Michael Gay Grosier, states that the Mayor altered the minutes of council meetings to include a session that never took place in November 2009 and alleges he violated environmental laws.

Mena visited the media, accompanied by Crosier, acting chairman of the Association for the Development of Cabarete, Aristide Trejo, Porfirio Martinez and Sandy Murray of the Neighborhood Association of La Cienaga de Cabarete, to ask the Department Against Administrative Corruption (DPCA) to listen to their complaints, saying the Mayor cannot be above the law or make fun of people who are interested in where their taxes and state resources are going.

Judge Yakaira Veras, acting in the Magistrate's Court of Puerto Plata recently set a bail bond of RD $ 100,000 (certified check or cash) and a ban on Mora leaving the country.

Mora appealed the decision, which the Court of Appeal then upheld as part of criminal proceedings initiated after his contempt of the civil court order to deliver the Council’s accounting and financial reporting issued in April last year.

Mena reported that in May last year ADECA filed a criminal complaint against Mora for his refusal to comply with the judgment of the court, but the prosecutor's office in Puerto Plata took no action.

Mena said that Article 30 of the Law on Free Access to Public Information states that any "public official or responsible  agent who arbitrarily denies, obstructs or impedes the applicant's access to the information required, shall be punished with imprisonment of six months to two years imprisonment, as well as disqualification from public office for five years.

So what's the delay? Why won't the prosecutors take action? If he's guilty he should be out and punished ASAP, if not, he should welcome the chance to have his day in court and clear his name.
